General

1.1 In these terms and conditions (referred to as the "Terms and Conditions"), "Starbucks" or "we" or "us" means Coffee Concepts (Hong Kong) Limited and the "customer" or "you" means any person, firm, company or body which places an order with us. Please read these Terms and Conditions carefully before using the Starbucks Hong Kong Online Store website (collectively "Online Store"). By using our Online Store or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

    1.2 We shall make every reasonable effort to ensure that prices, details and sizes of products at our Online Store are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.
    1.3 We shall make every effort to ensure product(s) displayed at our Online Store are in stock. If from time to time any products become out of stock, we reserve the right to offer alternative product(s) of similar value and style.
    1.4 All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable.

    2. Minors

    You acknowledge that you are at least 18 years old and are fully able to understand, agree to and abide by these Terms and Conditions. If you are between the ages of 13 and 18, you may only use our Online Store under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.  If your parent or legal guardian does not agree to these Terms of Use, you must discontinue its use.

    3. Personal Information

    3.1 You acknowledge and agree that in order to process and follow up your orders and payments and for other directly related purposes, we will use, collect and process your personal information voluntarily submitted by you. The personal information includes, without limitation, your name, phone number, delivery address, the product name, products, price and date of the purchase etc. If you place an order for other people, Starbucks will use, collect and process the information of the recipient designated by you, including but not limited to his/her name, delivery address and phone number.
    3.2 In addition, in order to deliver the products to you or the recipient designated by you, we will share with third-party partners personal information relating to you and the recipient designated by you, including name, phone number, delivery address, the product name, price and date of the purchase, etc.
    3.3 You should ensure that the designated recipient has agreed to your provision of the above personal information to us and agreed to share such personal information with the third-party partners by us for delivery purpose.
    3.4 Please read the Privacy Policy carefully to understand how Starbucks collects, uses and discloses information about its customers.

    4. Payment

    4.1 Our Online Store accepts payment by designated credit cards or other designated electronic means as specified by us. All product prices listed are in Hong Kong dollars. The prices listed in our Online Store may differ from the prices of the same products in our physical shops. The applicable price shall be the price listed in our Online Store as at the date of purchase.
    4.2 Acceptance of orders is subject to our sole discretion. A final receipt will be issued to you when goods are delivered to your address.
    4.3 To provide secure online transactions, we employ [Internet's Transport Layer Security (TLS) technology]. It encrypts your personal information, including credit card number, name and address, so that it would not be read as information travels over the Internet. 

    5. Supply of Goods

    5.1 We only serve and deliver products to end consumers. We are not selling our products for re-sell purpose. If we have grounds to believe that you are not purchasing our products as an end user, we reserve the right to decline or cancel your order.
    5.2 Title to the product shall remain vested in us until we receive full payment of the price, and risk shall pass to the customer upon delivery / collection of the product (as the case may be).
    5.3 For any ordered products remain undelivered for 7 days from the date of order confirmation, we shall have the right to dispose of such products at our own discretion without further notice to you. In such event, we shall not be liable to make any refund or compensation to you; and we reserve the right to continue claiming you for the outstanding fees.
    5.4 We have the right to refuse to provide the products to a customer if he/she violates the applicable laws and regulations or acts in a dishonest manner. The said action includes, without limitation, (i) using the Online Store by a customer to conduct illegal activities such as money laundering, theft of personal information, etc.; (ii) disrupting the normal operation of the Online Store, improperly interfering with the normal operation of the Online Store, or acting in a manner that is deemed inappropriate by us; (iii) providing fake or false information, or refusing to accept a delivery order without justifiable reasons, causing us being unable to deliver the products or a severe delay in completing the delivery service, any of which action  might have occurred for more than once.
    5.5 You agree to abide by all applicable laws and regulations and are solely responsible for your acts or omissions in connection with your use of our Online Store.

    6. Payment terms

    6.1 We accept [Visa, MasterCard, American Express, Apply Pay, Google Pay].
    6.2 Under Credit Card Purchase Protection service (e.g. Visa Verification Service, MasterCard Secure Code), customers can enjoy safe and secure shopping by using their own credit card with specific password or security code. Credit cards used for shopping should be valid and under the purchaser’s own name.
    6.3 Cash vouchers: Gift vouchers are not redeemable at our e-shop.
    6.4 Where there are additional charges for delivery, such charges will be set out separately for your acknowledgement and confirmation prior to proceeding to payment.
    6.5 Any transaction at our e-Shop will not be recorded in Starbucks RewardsTM Stars Collection.
    6.6 Unless otherwise as specified by Starbucks, you may not use any Starbucks RewardsTM member benefits and rewards, physical coupons, gift certificates, Starbucks Card eGift, Starbucks Drink eGift, etc. to redeem product(s) or deduct product price in the use of Online Store.

    Notification for ordering

    7.1 Our Online Store only accepts orders for delivery in Hong Kong to the specified delivery address.

      7.2 Placing an order means you agree to purchase products in accordance with the Terms and Conditions set out herein. After receiving your order, we will acknowledge receipt of your order. However, it is not an acceptance of your order. We reserve the right to reject any purchase order without giving any reasons. In the event that we are unable to accept your order (for example due to payment issue), we will notify you by phone or email.
      7.3 Subject to section 9.1 below, no order amendment, product exchange, order or product refund will be entertained after payment is made or order is confirmed by us.
      7.4 If your order is accepted by us, we will confirm with you accordingly and advise the delivery status.

      8. Delivery service

      8.1 You may enjoy free delivery service to your specified address when your order satisfies our minimum purchase amount at HK$350 at our Online Store (as specified under your invoice). For purchase amount below HK$350, a delivery charge of HK$30 shall apply (for individual order below 3 kg; and higher delivery charge will be imposed for order of 3 kg or above) .
      8.2 Delivery service is only available at addresses located in [Hong Kong Island, Kowloon, New Territories, Tung Chung, Discovery Bay and Ma Wan].  Delivery schedule or delivery service coverage may vary for remote areas, should you have any inquiry about delivery, please feel free to contact us through onlinestorhk@coffee-concepts.com
      8.3  For successful orders placed at our Online Store and confirmed by us via email, the estimated time for delivery to your specified delivery address will be made within [3 to 6] working days (except Sunday and public holidays).
      8.4  Delivery service is not available at restricted areas.
      8.5 After your order has been accepted, we will confirm with you about the expected delivery date. Please check whether all your ordered items are delivered against the invoice/delivery note (as the case may be) upon delivery.
      8.6 In case where the deliveries are delayed due to hoisting of typhoon signal no. 8 or above, red or black rainstorm signal, we will contact you to reschedule the delivery.
      8.7 If you fail to receive your ordered products upon the first delivery or you give us inaccurate information on your address, we reserve the right to charge you an additional delivery fee for subsequent delivery(es).
      8.8 All expected delivery dates are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery.
      8.9 In case of any dispute, our determination shall be final.

      9. Exchange and refund

      9.1 You are entitled to exchange products which are found to be damaged upon delivery. In such case, you can contact our customer service department to make arrangement for exchange within [3] days of receipt. Otherwise under normal circumstances, we would not accept any request for exchange of products, cancellation or refund of orders.
      9.2 If we agree you are entitled to an exchange but the products to be exchanged are sold out, you may return such product to us and apply the amount paid to buy alternative product(s).
      9.3 In exceptional case at our sole discretion, we will refund the amount paid to your credit card bank account (takes about 4-6 weeks).
      9.4 Original sales receipt or relevant electronic receipt must be produced to us for the request of a product exchange.
      9.5 All gift items must be returned together with the returned products. Otherwise the retail value of the gift item would be deducted from the refund.

      10. Copyright and Trademark

      10.1 Unless otherwise noted, all materials on our Online Store are protected as the copyrights, trade dress, trademarks and/or other intellectual properties owned by Starbucks and/or its subsidiaries and affiliates or by other parties that have licensed their material to Starbucks. All rights not expressly granted are reserved.
      10.2 Your use of the materials included on our Online Store is for informational purposes only. You agree you will not distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this site in any way. You agree to indemnify, defend and hold harmless Starbucks for any and all unauthorized uses you may make of any material on our Online Store. You acknowledge the unauthorized use of the contents could cause irreparable harm to Starbucks and that in the event of an unauthorized use, we shall be entitled to an injunction in addition to any other remedies available at law or in equity.
      10.3 Some links on our Online Store will allow you to connect with sites that are not under our control. We are providing these links only as a convenience. The appearance of a link does not imply Starbucks endorsement, nor is Starbucks responsible for the contents of any linked site. You access them at your own risk.

      Indemnification

      At Starbucks’s request, you agreed to defend, indemnify, and hold harmless Starbucks, Starbucks Corporation and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) that arise from or relate to the your use or misuse of Online Store, violation of these Terms and Conditions or violation of any rights of a third party. Starbucks reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses.

      12. Warranties; Disclaimers

      STARBUCKS IS PROVIDING THE Online Store TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND YOU ARE USING THE Online Store AT YOUR OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, STARBUCKS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW, TRADE USAGE, OR OTHERWISE, INCLUDING ANY WARRANTIES THAT THE products are MERCHANTABLE, RELIABLE, AVAILABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED OR SATISFACTORY QUALITY, NON-INFRINGING OR FREE OF DEFECTS OR VIRUSES OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF THE Online Store BY YOU are IN COMPLIANCE WITH LAWS APPLICABLE TO YOU THAT YOUR INFORMATION TRANSMITTED IN CONNECTION WITH THE Online Store WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED OR RECEIVED, THAT ORDER WILL BE AS PLACED OR READY AT THE SUGGESTED TIME,OR THAT ANY PARTICULAR ITEM ORDERED WILL BE AVAILABLE.

      Starbucks reserves the right to stop the operation of the Online Store at any time and for any reason.

      13. No Liability

      13.1 TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL STARBUCKS OR THEIR AFFILIATED COMPANIES (A) BE LIABLE TO YOU WITH RESPECT TO USE OF THE Online Store; AND (B) BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF YOUR INFORMATION, THE INABILITY TO USE THE Online Store OR ANY OF ITS FEATURES OR DEVICE FAILURE OR MALFUNCTION. YOUR SOLE REMEDY IS TO CEASE USE OF Online Store. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT (BUT SUBJECT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW) SHALL THE AGGREGATE LIABILITY OF STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE Online Store,  EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO STARBUCKS FOR ACCESS TO OR USE OF THE Online Store,  for a particular order GIVING RISE TO SUCH LIABILITY. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, NOTHING IN THESE TERMS SHALL EXCLUDE OR RESTRICT STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES’ LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THEIR NEGLIGENCE.
      13.2 In no event shall Starbucks be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond our reasonable control including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, electrical power failures, strikes, labour disputes, riot, protest, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties.

      Amendments to These Terms and Conditions

      Starbucks encourages you to regularly check these Terms and Conditions, learn about the latest version, and consider whether or not to continue to use the Online Store.
      Starbucks has the right to revise these Terms and Conditions from time to time. In such case, Starbucks will notify you in advance of the amended Terms of Use and the effective date hereof, and also publish the amended Terms and Conditions. If you continue to use the Online Store on or after the effective date of any such amendment, it will be deemed that you accept these Terms and Conditions as amended.

      15. Governing Law and Dispute Resolution

      These Terms are governed by the laws of Hong Kong, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. You irrevocably consent to the non-exclusive jurisdiction of the courts of Hong Kong for purposes of any legal action arising out of or related to the use of the Online Store or these Terms.

      In the case of discrepancies between the English and Chinese versions, the English version shall prevail.

      1.2 我們會盡一切努力確保網上商店上所列載的貨品價格、資料和大小均已更新。我們保留權利可更改貨品的價格而不作另行通知。我們可根據存貨供應,全權決定是否接受所有訂購。
      1.3. 我們會盡一切努力確保網上商店上所列載的貨品提供存貨供應。如任何貨品因缺貨而未能提供予顧客,我們有權提供相同種類及價格的貨品以供替代。
      1.4. 所有訂單須視乎相關貨品的供應情況再作最後確認。倘若我們未能提供任何已訂購之產品或服務,我們有權拒絕接受該訂單。

      2. 未成年人

      你聲明您的年齡已滿18歲,並且完全有能力理解、接受並遵守本使用條款。如你的年齡是13至18歲之間,你可以在您同意遵守本使用條款的父母或監護人的監督下使用網上商店。如你的父母或監護人不同意本使用條款,你必須停止使用。

      3. 個人資料

      3.1 您了解並同意,為了跟進您的訂單及付款及其他直接有關用途,星巴克會向您收集和處理您自願提供的個人資料,這些個人資料包括但不限於您的姓名、電話號碼、送遞地址、您所購買的產品的名稱、金額和日期等。如果您是為別人訂購,星巴克還使用,會向您收集和處理您指定的收件人的個人資料,包括但不限於其姓名、送遞地址和電話號碼。
      3.2 此外,為了向您或您指定的收件人送遞產品,星巴克還會與第三方合作夥伴分享您或您指定的收件人的個人資料,包括但不限於姓名、電話號碼、送遞地址、所購買或配送的產品的名稱、日期等信息。
      3.3 您應確保您指定的收件人已同意您向星巴克提供上述個人資料,並同意星巴克可以為送遞的目的與第三方合作夥伴分享上述個人資料。
      3.4 請仔細閱讀《私隱保護政策》,了解星巴克如何收集、使用和披露其顧客的資料。

      4. 付款方式

      4.1. 網上商店接受我們所指定的信用卡或其他指定的電子支付方式付款,所有貨品之價值均以港幣計算。[網上商店的貨品價格有可能與我們的實體店鋪有所出入,貨品以訂購當日網上商店所示之價格為準。
      4.2. 所有網上訂購的貨品須由我們全權決定並根據存貨供應而接受。閣下將於送貨收取貨品時收到最終的購物收據以作記錄。
      4.3. 為提供安全可靠的網上購物服務,網上商店的交易使用安全接層加密技術 Transport Layer Security (TLS)。所有個人資料包括您的信用卡號碼、姓名、地址等,會經過加密,才透過互聯網傳送,防止您的資料在網上傳送時,被未經許可的第三者閱讀。

      5. 供貨

      5.1. 我們僅向最終消費者銷售和運送產品。我們不會銷售我們的產品用於作轉售用途。如果我們有合理的依據認為您購買我們的產品並非作為自用,我們有權拒絕或取消您的訂單。
      5.2. 直至顧客清付購買產品之全部款項,我們將保留擁有有關產品之物權,而相關之風險將於有關產品送交予顧客之同時視作已轉交予顧客。
      5.3. 我們有權銷毀訂單確認通知日期超過7日仍未收取的貨品,而毋須另行通知。在此情況下,我們不會向您退款或賠償; 我們保留繼續向您索取費用的權利。
      5.4  如果用戶違反了法律法規或存在不誠實的行為,星巴克有權拒絕向用戶提供任何產品。前述行為包括但不限於:(i) 用戶利用網上商店從事洗黑錢、盜取個人信息等違法活動;(ii) 用戶干擾網上商店的正常運行,干擾網上商店的正常經營,或採取其他星巴克認為不適當的行為;(iii) 用戶提交的信息虛假或錯誤,或無正當理由拒收訂單等行為,導致無法送遞或送遞發生嚴重延遲,並且類似情況多次發生。
      5.5 您同意遵守所有適用法律及規則,及自行負責有關使用網上商店的行為或過失。

      6. 付款條件

      6.1 我們接受Visa、MasterCard 、美國運通卡、Apple Pay及Google Pay付款。
      6.2 網上商店使用指定信用卡購買保障服務(例如Visa驗證服務及MasterCard Secure Code服務),可以讓您在使用Visa卡及MasterCard卡時安心及安全地進行網上購物。該服務透過特定的個人密碼或保安編碼,以確保您是唯一有權使用該卡的人。您應使用您自己名下有效的信用卡進行網上購物。
      6.3 現金券:網上商店不接受實體現金禮券。
      6.4 如果有額外的送貨費用,這些費用將在您付款之前另行進行確認。
      6.5 使用網上商店的任何交易都不會記錄及計算在Starbucks RewardsTM 的星星獎賞計劃中。
      6.6 除星巴克另有所定,Starbucks RewardsTM會員優惠及獎賞、實體優惠券、禮券、星巴克卡eGift及星巴克飲品eGift不能在網上商店內使用以兌換產品或扣減產品價格。

      7. 訂購通知

      7.1. 網上商店只接受在香港的指定送貨地址。
      7.2. 您向我們訂購產品時,即表示您同意按照本條款及細則向我們提出購物請求。收到您的訂單之後,我們將通知您並確認收到該訂單。該回覆並不代表我們已經接受您的訂單。我們有權拒絕接受該訂單而不需提供任何原因。倘若我們無法提供閣下訂單上的任何產品(例如由於付款問題),我們會透過電話或電郵通知閣下。
      7.3  除第9.1條另有規定外,當我們已接受您的訂單或付款已完成後,更改訂單、轉換產品、訂單或產品退款等要求將不被接納。
      7.4. 閣下的訂購請求獲我們接受後,我們會與您確認接受訂單,並同時為您提供送貨狀態。

      8. 送貨服務

      8.1 每次於網上商店購物金額滿港幣350元或以上,您可免費享用送貨服務(詳情載於發票內)。購物金額於港幣350元以下須付港幣30元送貨服務費(只限總重量為3公斤以下之訂單; 如總重量為3公斤或以上之的訂單,送貨服務費會增加)。
      8.2 送貨服務僅限於固定地址,服務範圍包括香港島、九龍、新界、東涌、愉景灣及馬灣。偏遠地區的送貨時間及服務範圍或會有不同,如你對於送貨安排有疑問,請透過電郵onlinestorehk@coffee-concepts.com 向我們查詢有關送貨服務安排之詳情。
      8.3 於網上商店成功訂購、訂單獲接受、完成付款並收到電郵確認後,我們將在3至6個工作天內送貨到您的指定送貨地址(星期日及公眾假期除外)。
      8.4 送貨服務不適用於邊境禁區。
      8.5 當您於網上商店提交訂單後,如訂單獲我們接受,我們將會與您確認預計送貨日期。貨物送抵時,請您點收訂購了的貨品是否齊全,並由收件人在送貨單上寫上姓名及簽名確認收取貨品。
      8.6 若懸掛八號或以上颱風訊號、紅色或黑色暴雨警告,我們將與你聯絡以為你重新安排送貨服。
      8.7 如果您因在首次約定的送貨預約時失約或因您提供不準確地址而導致您未能收取您訂購的產品,我們會就其後的送貨預約保留向您收取額外送貨費用的權利。
      8.8 所有送貨日期和時間均為預計送貨日期。就您可能因為送貨延誤所可能造成的損失或損害,我們恕不負任何責任。
      8.9 如有任何爭議,我們保留最終的決定權。

      9. 換貨及退款

      9.1 若閣下收貨時發現產品損壞,可於[3]天內聯絡顧客服務部以安排更換產品。否則一般情況下,我們不接受任何換貨、取消訂單或退款的要求。
      9.2 如果我們同意你有權更換產品,但所要求更換之貨品已經售罄,我們會退回相關款項給您。
      9.3 在我們獨立決定及特殊情況下,我們將退回網上購物所涉及之款項到您的信用卡銀行户口(需時約4至6星期)。
      9.4 在接受產品交換之前,請向我們出示購物收據正本或相關的電子收據。
      9.5 貨品必須與所有購買時所附送之贈品一併退還,否則我們將從退款中扣除該贈品的價值。

      10. 版權及商標

      10.1 除非另行注明,網上商店之所有資料均作爲星巴克及/或其子公司及附屬公司或由將此等資料許可給星巴克的其他方所擁有的版權、商品外觀、商標及/或其他知識産權而受到保護。 所有未明確授予的權利均予以保留。
      10.2  你使用的本網站所包含的資訊僅供參考之用。你謹此同意不以任何方式散佈、公佈、傳播、修訂、展示本網站之內容或從其中創造衍生性作品或對之加以利用。您謹此同意就您對本網站之任何材料的任何可能的未經授權的使用向星巴克作出彌償,爲星巴克進行抗辯並使星巴克不受其之影響。你謹此承認,因爲對內容未經授權的使用可能給星巴克造成難以彌補的損害,故若發生未經授權的使用,星巴克有權在可能獲得的任何普通法下或衡平法下的其他救濟之外再申請禁制。
      10.3 本網上商店上的某些鏈結將能使你連接到不受我們控制的網站上。星巴克提供此等鏈結僅是爲方便起見。鏈結的標誌並不暗示星巴克同意被鏈結網站之內容,且星巴克亦不對任何被鏈結網站的內容負責。如您登錄此等網站,須自行承擔風險。

      11. 彌償

      在星巴克的要求下,用戶同意就任何因用戶使用或不當使用網上商店、違反這些使用條款或者第三者的權利而引致或與之相關的任何或全部索賠、訴訟、損害賠償、費用、法律訴訟、罰款、處罰、責任和支出(包括律師費),為星巴克及其關聯公司、獨立承包商、服務提供商和顧問、以及其相關僱員、合約商、代理高級職員和董事抗辯、賠償並保證其不受損失。對於在星巴克未採取專項抗辯和監督下用戶需承擔彌償責任的情況,星巴克保留採取此類專項抗辯和監督的權利,發生此類情況時,用戶將給予合作,堅持主張一切可以利用的抗辯理由。

      12.保證;免責聲明

      星巴克以現狀(「as is」)的狀態為使用者提供網上商店服務,而用戶則自己承擔使用網上商店的風險。星巴克在適用法律允許的最大範圍內,不提供任何保證,不論明示或默示,包括此處列出的一切擔保:產品適宜銷售、具有可靠性、具有可用性、具有精確性、適合特定用途或需要、不具侵犯性、無缺陷或病毒、可以不受幹干擾地運作、用戶遵照適用於該用戶的法律使用網上商店、或者與網上商店有關的傳輸使用者資訊將可成功地、精確地、或安全地傳輸或接收,將在建議時間內可以訂購或準備好訂購,或將會提供所訂購的特定產品。
      星巴克保留在任何時間及以任何原因撤銷網上商店的權利。

      13.免責

      13.1 在適用法律允許的最大範圍內,在任何情況下,星巴克及其關聯公司(a)就用戶使用網上商店,毋需承擔任何責任;以及(b)就一切直接、非直接、特殊、連帶的、相應的或懲罰性的損害賠償(包括但不限於商譽損失賠償、利潤損失賠償、損失賠償、使用者資料被盜竊或破壞)、不能使用網上商店或其任何功能或者設備失效或故障,毋需承擔任何責任。用戶唯一的解決方案是停止使用網上商店。在適用法律允許的最大範圍內,在任何情況下(但視適用法律允許的最大範圍而異),星巴克及其關聯公司因為或涉及用戶使用或不能使用網上商店而承擔的法律責任(不論是基於合同、侵權(包括出於疏忽)、嚴格法律責任還是其他論述)的總額不可超過用戶在與造成此責任曾為瀏覽或使用網上商店的有關訂購而向星巴克支付的費用。
      13.2 對於自然災害或星巴克不能合理地控制的原因,包括但不限於互聯網故障、電腦設備故障、電訊設備故障、電力故障、罷工、勞工糾紛、勞工或材料短缺、火災、水災、風災、爆炸、天災或第三者延誤或不履行任務直接或間接造成的任何延誤或不履行,星巴克在任何情況下概不負責。

      14.本使用條款的修訂

      星巴克鼓勵您經常查看本使用條款,了解最新版本並考慮是否繼續使用網上商店。

      星巴克有權不時修訂本使用條款。在該等情形下,星巴克將會提前在應用程式內通知您修訂後的使用條款及其生效日期,並且會公示修訂後的使用條款。如果您在修訂後的使用條款的生效日當天或之後使用網上商店的,即表示您接受了修訂後的使用條款。

      15. 適用法律及爭議解決

      這些條款適用香港法律,無需考慮法律衝突規則。聯合國國際貨物銷售合同公約(United Nations Convention on Contracts for the International Sale of Goods)不應適用於這些條款。用戶不可撤回地同意香港法庭就因使用網上商店或這些條款或與之相關而進行的任何法律行動具有非專屬管轄權。
      這些條款的英文本如與中文譯本之文義有任何歧異,概以英文本為準。
